Prime suspect pleads not guilty in Briton’s murder as DPP seeks extended detention

Alex Mutua Kithuka has pleaded not guilty to charges of planning and killing British national Campbell Scott Alistair.

Appearing before Justice James Wakianga at the Makadara Law Courts on Tuesday, May 27, 2025, Mutua denied killing Scott Alistair on February 16, 2025, in the Pipeline area within Nairobi County.

Meanwhile, the Director of Public Prosecutions (DPP) requested the court to allow the continued detention of the accused for an additional seven days.

Furthermore, the DPP informed the court that an affidavit opposing the accused’s release on bail would be filed.

Justice Wakianga ordered the DPP to submit the affidavit within three days.

He also directed probation officers to prepare their report before the next mention of the case.

On March 25, 2025, Milimani Law Courts Chief Magistrate Lucas Onyina released the second person of interest in the Briton’s murder, Albunus Mutinda Nzioki.

This followed a request by the DPP, through lawyer Joyce Olajo, to release Mutinda on the condition that he report to the police station when required.

“We request the court to release Albunus Mutinda on the condition that he will be reporting to the police station to assist with investigations,” prosecutor Olajo told the court.

Olajo added that Mutinda’s assistance would be necessary to help the investigative officer apprehend two other persons of interest in the murder, who are still at large.

According to Sergeant Philip Kilonzo, attached to the Homicide Investigations Department, the deceased, who disappeared on February 16, 2025, was killed and his body dumped at Makongo Forest along the Machakos-Wote Road on February 21, 2025.

Kilonzo also stated that the deceased’s body was tied at the hands and legs and dumped in a thicket inside a green nylon sack.

“The body was tied at the hands and legs, placed in a green nylon sack, and dumped in a ditch about 500 meters from the Makongo Forest viewpoint,” part of the application read.

Furthermore, the application stated that investigations revealed the deceased was taken to Pipeline, to Alex Mutua’s house, where he is believed to have been murdered, and the body was later disposed of at Makongo.

Later, the two suspects were accused of attempting to withdraw money from the deceased’s account in Nairobi, Voi, and Mombasa.

The matter will be mentioned on June 17, 2025, for the hearing of the bail application and a pre-trial.
